Nextdevstore ("we," "us," or "our") is committed to protecting your personal data in compliance with the General Data Protection Regulation (EU) 2016/679 ("GDPR"), the ePrivacy Directive 2002/58/EC, and applicable Romanian data protection legislation (Law No. 363/2018). This Privacy Policy explains how we collect, use, store, and protect your personal information when you interact with our digital services.

1.3 Lawful Bases for Processing

We process your personal data under the following lawful bases as defined in Article 6(1) GDPR:

1.4 Data Retention Periods

Your personal data is retained only for as long as necessary to fulfill the purposes for which it was collected:

  • \u25B8Contract-related data: Duration of the contractual relationship plus 5 years (as required by Romanian commercial law).

1.5 Data Transfers & International Safeguards

Your data is primarily processed within the European Economic Area (EEA). Where transfers outside the EEA are necessary (e.g., to third-party service providers), we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission or adequacy decisions under Article 45 GDPR.

1.8 Data Security Measures

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption of data in transit (TLS 1.3), access controls, regular security assessments, and staff training on data protection obligations.

2.1 What Are Cookies

3. Refund Policy

3.1 Scope of Application

This Refund Policy governs all service engagements between Nextdevstore and its clients. It applies to digital services, consulting engagements, and custom development projects undertaken pursuant to a signed Statement of Work (SOW) or project agreement.

3.2 Cancellation Before Project Commencement

If a client cancels a project before any substantive work has commenced (defined as within 5 business days of contract execution and prior to the first sprint kickoff), a full refund of any advance payments will be issued within 14 business days. An administrative fee of 5% of the total project value may apply to cover administrative processing costs.

3.3 Cancellation During Active Project Execution

For projects cancelled after commencement, refunds are calculated based on completed project milestones:

  • \u25B8Milestone-Based Billing: Clients are invoiced upon completion of each defined milestone. Work completed and approved is non-refundable.
  • \u25B8In-Progress Milestones: If cancellation occurs mid-milestone, the client will be invoiced proportionally for work completed up to the date of cancellation, calculated at the applicable hourly rate for time invested.
  • \u25B8Advance Deposits: Any unapplied portion of advance deposits will be refunded within 30 business days of project termination.

3.4 Deliverable Disputes

If a client disputes the quality of delivered work, a formal review process will be initiated within 10 business days of the dispute notification. Nextdevstore will provide evidence of compliance with the agreed specifications. If the dispute is resolved in the client's favor, appropriate remediation or partial refund will be applied as negotiated in good faith.

3.5 Refund Processing

All approved refunds will be processed via the original payment method within 30 business days of approval. Refund requests must be submitted in writing to [email protected] with the subject line "Refund Request - [Project Name]."

4. Terms of Service

4.1 Acceptance of Terms

By accessing or utilizing the services provided by Nextdevstore ("Provider"), you ("Client") agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use our services.

4.2 Service Description & Scope

Nextdevstore provides digital engineering, software development, and consulting services as described in individual Statements of Work (SOW) or project proposals. The specific scope, deliverables, timeline, and pricing for each engagement are defined in the respective SOW, which forms an integral part of these Terms.

4.3 Intellectual Property Rights

Upon full payment of all applicable fees, the Client receives full ownership of all custom deliverables produced specifically for the Client under the engagement. Nextdevstore retains ownership of pre-existing tools, frameworks, methodologies, and general know-how used in the creation of deliverables. The Client grants Nextdevstore a non-exclusive, revocable license to use project-specific knowledge for internal training and quality improvement purposes only.

4.4 Payment Terms

  • \u25B8Invoices are payable within 14 calendar days of issuance unless otherwise specified in the SOW.
  • \u25B8Late payments incur a statutory interest rate of 8 percentage points above the ECB base rate, in accordance with Directive 2011/7/EU on late payments in commercial transactions.
  • \u25B8All prices are quoted in Euros (\u20ac) and are exclusive of applicable VAT unless explicitly stated otherwise.
  • \u25B8Payment methods accepted: bank transfer, Stripe (credit/debit card), or other methods specified in the SOW.

4.5 Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information shared during the course of the engagement. This obligation survives termination of the agreement for a period of 3 years. Confidential information includes but is not limited to: business strategies, technical specifications, source code, financial data, and client lists.

4.6 Limitation of Liability

Nextdevstore's total aggregate liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. In no event shall Nextdevstore be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

4.7 Force Majeure

Neither party shall be liable for failure to perform its obligations where such failure results from circumstances beyond the reasonable control of the affected party, including but not limited to: natural disasters, pandemics, government actions, cyberattacks, or infrastructure failures. The affected party must provide written notice within 7 days of the force majeure event.

4.8 Governing Law & Dispute Resolution

These Terms are governed by the laws of Romania and the European Union. Any disputes arising from or in connection with these Terms shall first be resolved through good-faith negotiation. If no resolution is reached within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Botosani, Romania.

4.9 Amendments

Nextdevstore reserves the right to amend these Terms at any time. Material changes will be communicated via email to registered clients at least 30 days before the amended terms take effect. Continued use of services after the effective date constitutes acceptance of the amended Terms.

4.10 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
